MOSELEY SEEKS APPEALS COURT SLOT
Marshall resident Bailey Moseley is among a field of three Republican candidates seeking the party's nomination to serve on Texarkana's Sixth District Court of Appeals.
Also listed on the March 7 Republican Party ballot are M. C. Bruder of Fannin County and Andrew Khoury of Longview . The Democratic Party candidate is Ben Franks.
The race has generated interest due to the retirement of incumbent Place 2 Justice Donald Ross of Henderson from the three-member court.
While Moseley believes voters have a "clear choice" because of his experience, he said campaigning is difficult. "It's a 19-county district," Moseley said. "It would be nice if I could be cloned."
Pointing out he has "prepared and argued numerous cases" before the appeals court, Moseley added: "my main opponent in the primary, and also in the general election, are personal injury trial lawyers."
The Texarkana court hears criminal and civil cases appealed from courts within Northeast Texas and is often assigned cases from Dallas and Houston, Moseley explained.
"People have been really nice and very receptive. The problem is finding about events" to share his candidacy with voters. "It's primarily by word of mouth," Moseley said.
"I was at a Rusk County event Saturday when another candidate in another race told me" of an upcoming forum. "It's been a learning experience," Moseley added.
Describing himself as a "conservative," Moseley notes he has long been active in the State Bar of Texas, Northeast Texas Bar Association and Harrison County Bar Association.
He frequently serves as an instructor for continuing legal education seminars statewide.
Moseley has practiced law locally for 35 years, including service in the district attorney's office.
He is a director of the Texas College of Real Estate Probate and Trust Law section of the Texas State Bar, and is vice chairman of the legislative action committee of the REPTL section of the Texas Bar Association.
Moseley is an active member of Cypress Valley Bible Church and was a founder of Marshall Soccer Association. He served on the city of Marshall Charter Revision Commission , as a library trustee and as a member of the Planning and Zoning Commission. He recently resigned from the Cypress Valley Navigation District board.
In order to reduce costs of legal services, Moseley worked closely with members of the Texas Legislature to simplify documentation processes and to make legal documents more understandable for non-lawyers.
State lawmaking committees have consulted him on language to be used in new laws.
Moseley said he looks forward to serving on the court, which he said, "has a history of solid judicial decision making, respected throughout the state.
"I will make fair decisions based solely on the law and the cases submitted to the court. The judge's bench is a place for interpreting the law – not making new law," Moseley said. "My (law) practice has been broad enough in scope to give me experience in representing plaintiffs and defendants.
"This position is important to the citizens of Texas , and particularly to the people of Northeast Texas ," Moseley said. "I look forward to continuing the high standard set by the fine judges who have served the district."
Dr. John Coppedge, a state judicial activist and long-time acquaintance of Moseley's said: "The voters have a great choice with (his) years of experience and conservative temperament."
Moseley, 61, is a fifth generation Texan and life-long resident of Harrison County . He and his wife of 39 years, Kay Saxon Moseley, have two children, Chris, 38, and Meredith, 35.
